Personal Information We Collect and How We Collect It

Jbaun Bullion gathers personal data that can be connected to a specific individual or household, such as identifiers, descriptions, or information that can be related to them (“Personal Information”). Additionally, Jbaun Bullion collects non-Personal Information that cannot be linked to any particular person or household. If, however, this non-Personal Information is combined with other details that could identify an individual, we will regard it as Personal Information. Please note, if you do not provide any requested Personal Information, we may be unable to fulfill the contract we have made or are trying to enter into with you. How Do We Protect Your Personal Information?

Jbaun Bullion ensures the security of its customers' information by using an industry-standard SSL (Secure Socket Layer) provided by Cloudflare. This SSL creates a secure and encrypted https:// website address for sensitive pages like Checkout and My Account. You can identify a secure site by the presence of https:// in the website address. Our company also adheres to Payment Card Industry Data Security Standards to protect credit card information, which is tokenized following PCI-compliant standards and not accessible by Jbaun Bullion. While no transmission or storage method is foolproof, we implement and maintain industry standards to prevent unauthorized access, use, modification, destruction, or disclosure of personal information both during transmission and upon receipt.

How Do We Disclose Your Personal Information?

Jbaun Bullion takes great care to protect its customers' personal information. Our privacy policy clearly states that we do not sell, rent, or otherwise share customer information with any third parties, unless required by law. Furthermore, all our customer data is stored and transmitted securely, in accordance with industry standards. In addition, Jbaun Bullion limits access to all customer data to only those who need access to fulfill their job duties and is regularly audited to ensure compliance with our policies. In the event of a change in ownership of the business, such as a sale, transfer, or merger, the new owners may use the customers' Personal Information in the same manner as set out in this Policy.

Finally, Jbaun Bullion may disclose information about its customers as required by law, regulation or legal process, or in response to requests by government entities or to prevent physical, financial, or other harm, injury, or loss. The California Consumer Privacy Act (CCPA) gives residents of California the right to access, modify, or delete information that companies have collected about them. The following information explains how to exercise these rights and how to access your personal data.

After confirming your identity, you are able to:

Verifying Your Identity to Make Requests:

California consumers and business contacts are subject to certain rights regarding their Personal Information. If you wish to exercise one of these rights, you, or a person registered with the California Secretary of State that you have authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. If you wish to use an authorized agent to make a request, you must provide the agent with signed written permission that clearly describes their authority to make the request on your behalf. Furthermore, you must verify your identity, as well as directly confirm that you have given the authorized agent permission to make the request. Additionally, the authorized agent must be able to verify their identity with us and provide proof of their authority to act on your behalf.

Your or your authorized agent's verifiable consumer request must include::

Your full legal name, email, and phone number, which we will need to contact you in order to verify that you are the person about whom we collected Personal Information or an authorized representative.

A detailed description of your request so that we can understand, evaluate, and respond to it effectively.

Creating an account with us is not necessary to make a verifiable consumer request. A representative of ours may contact you to verify your identity, and you may be asked to provide additional information to verify your request. Depending on the nature of the request, additional verification steps may be taken, such as providing a signed declaration under penalty of perjury that you are the individual whose Personal Data is being requested. We will only use the provided information to verify the identity or authority of the requestor.

Denial of Requests:

We cannot fulfill your request for Personal Information unless we are able to verify your identity and authority to make the request, and confirm that the Personal Information relates to you. 

If we, or our service provider(s), require the retention of the information for the purposes listed below, we may deny your request for deletion:

To finish the transaction for which we gathered your Personal Information, give the good or service you requested, take necessary steps that are typical in our ongoing business relationship with you, or fulfill our contract with you.

To take action to identify and prevent security incidents, defend against malicious, deceptive, fraudulent, or illegal activity, and hold accountable those responsible for such activities.

To Identify and fix errors that interfere with intended product functions in order to debug them.

To comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 ).

To engage in public or peer-reviewed scientific, statistical, of historical research in the public interest that also adheres to all other applicable ethics and privacy laws, in the case that the deletion of the information may make it impossible or seriously impede the research's success.

To only allow internal uses that are consistent with consumer expectations given our relationship.

To comply with a legal obligation.

To utilize the information for other internal and lawful purposes that are consistent with the way it was originally provided.

We strive to answer any verifiable consumer request we receive within 45 days. In the event we need more time (up to 90 days) to process the request, we will send you a written explanation for the delay as well as the extension period. Unless the request is excessively repetitive, manifestly unfounded, or requires excessive effort, we will not charge a fee to fulfill the request.

The California Consumer Privacy Act (CCPA) ensures that you cannot be discriminated against if you decide to take advantage of the rights granted to you by the law. We promise not to discriminate by:

Denying you goods or services.

Varying the prices or rates charged for goods or services, including offering discounts, benefits, or imposing penalties.

Offering you a different level or quality of goods or services.

Suggesting that you may be eligible for a different price, rate, level, or quality of goods or services.

California residents have the right to obtain information about the third parties with whom Jbaun Bullion has shared their Personal Information in the past calendar year. This information is available free of charge once a year by contacting us using the information listed on our website. Additionally, a description of the categories of Personal Information disclosed to those third parties would be included.

California Privacy Rights Act (CPRA)

The California Privacy Rights Act (CPRA), often referred to as "CCPA 2.0", slightly increases the criteria for what is considered a covered "business" in California. The CPRA is an amendment to the CCPA and was approved by California voters in November 2020. The CPRA strengthens the existing privacy protections provided by the CCPA and adds additional consumer rights. The CPRA expands the rights of California consumers to know what personal information a company has collected about them, the right to correct that information, and the right to opt-in to the sale of their personal information. It also strengthens the enforcement of the CCPA and creates a new consumer privacy enforcement. Until January 1, 2023, a company doing business in California was subject to the CCPA if it made $25 million in annual gross revenues, collected personal information from 50,000 or more California consumers, households, or devices, or derived more than 50% of its revenue from selling personal information.

As of January 1, 2023, companies must now meet the criteria of the CPRA to remain covered. Most companies that had annual gross revenues exceeding $25 million in the preceding calendar year will still be included in the CPRA. However, businesses that were previously included in the CCPA due to collecting personal information from 50,000 devices, for example, are no longer covered by the CPRA.

Here are the most notable updates in the CPRA that differ from the CCPA:

Expansion of Private Right of Action: The CPRA provides consumers with the right to sue companies for alleged violations of the statute, something not available under the CCPA. 

Expansion of Private Right of Data Access: The CPRA requires companies to provide consumers with access to their personal information upon request. 

Broader Definition of Personal Information: The CPRA expands the definition of personal information to include biometrics, geolocation, and inferences from other data.

Expansion of the Definition of “Third Party”: The CPRA expands the definition of “third party” to include companies that process the personal information of the consumer on behalf of the business.

OTHER STATES’ PRIVACY RIGHTS

Know Your Privacy Rights in Virginia, Colorado, Connecticut, and Utah.

Startingon January 1, 2023, the state of Virginia will have new consumer privacy laws that give you rights with respect to your Personal Information. Additionally, new privacy law amendments will go into effect for Colorado and Connecticut on July 1, 2023, and for Utah on December 31, 2023. Here's what you need to know:

Right to Access: You can request to know what Personal Information of yours we have collected, used, disclosed, and sold. Simply contact us at jbaunbullion@gmail.com If you want, you can also have someone else (an authorized agent) make the request for you.

Right to Delete: You can request that we delete your Personal Information. Just contact us at jbaunbullion@gmail.com You can also have someone else (an authorized agent) make the request for you.

Right to Correct: You can request that we correct your Personal Information. Just contact us at jbaunbullion@gmail.com. You can also have someone else (an authorized agent) make the request for you.

Right to Opt-Out of Sale or Sharing: You can request to opt-out of having your Personal Information used for targeted advertising, sold, or used for making important decisions. Simply contact us at jbaunbullion@gmail.com. Residents of Colorado and Connecticut can also have someone else (an authorized agent) make the request for them.

Colorado: The Colorado Privacy Act gives Colorado residents the right to decline targeted advertisements and the sale of their personal data, as well as certain types of profiling. Starting July 1, 2024, controllers must respect the universal opt-outs selected by users to decline targeted advertising and sales.

 

Right to Appeal: If we deny your request, you have the right to appeal our decision. Simply follow the instructions in our response. You can also call us at (800)852-6884. We'll respond to appeals from Virginia residents within 60 days and from Colorado and Connecticut residents within 45 days.

When you make a request, we'll need to verify your identity by asking you to log in to your account or by asking for your email address, order number, or other information. We may also use a third-party verification service. Unless there are legal exemptions, we will try our best to honor your request..

Please note that exercising your privacy rights will not affect the price or quality of our goods or services.

When you purchase items from Jbaun Bullion or sign-up for any Jbaun Bullion services, you may be offered to opt-in to receive emails regarding special offers or new products/services. If you do not wish to subscribe to such emails, simply leave this option unchecked. If you initially opt-in but decide later to opt-out, you may click the “unsubscribe” link at the bottom of any one of our emails to do so.
